Backyard Birdies Chico

1. Acceptance of Terms

By accessing or using the website located at https://backyardbirdieschico.com/ (the “Site”), booking services, renting equipment, or communicating with Backyard Birdies Chico (“Company,” “we,” “us,” or “our”), you agree to be bound by these Terms of Use, our Privacy Policy, and any additional terms provided at the time of booking.

If you do not agree to these Terms, please do not use our Site or services.

2. Services Provided

Backyard Birdies Chico provides portable mini golf rentals and related event entertainment services, including equipment such as mini golf boards, obstacles, putters, balls, flags, and accessories.

All services are subject to availability and confirmation.

3. Booking, Deposits & Payment

3.1 Deposit Requirement
A non-refundable deposit of 10% of the total rental fee is required to reserve your event date.

3.2 Balance Due
The remaining balance must be paid in full on or before the event date. Failure to pay may result in cancellation of your booking.

3.3 Accepted Payment Methods
We accept credit card, Zelle, check, and cash.

3.4 Pricing
Prices are subject to change until a booking is confirmed.

4. Cancellation Policy

4.1 14+ Days Before Event
Deposit is forfeited; no additional charges apply.

4.2 7–13 Days Before Event
50% of the total rental fee is due.

4.3 Less Than 7 Days Before Event
100% of the total rental fee is due.

4.4 Company Cancellation
If we must cancel due to unforeseen circumstances, a full refund (including deposit) will be issued or rescheduling will be offered.

5. Rental Period & Equipment Use

5.1 Rental Period
The rental period begins at delivery/setup and ends at pickup unless otherwise agreed.

5.2 Proper Use
Equipment must be used only for its intended purpose (mini golf play) and handled with reasonable care.

5.3 Prohibited Use
You agree not to:

-Use equipment with objects other than provided golf balls

-Move, modify, or disassemble equipment without permission

-Use equipment in a way that may cause damage or injury

6. Equipment Responsibility & Damage

6.1 Responsibility
You are fully responsible for all equipment from delivery through pickup.

6.2 Damage or Loss
You agree to pay for repair or replacement costs resulting from damage, loss, theft, or misuse exceeding normal wear and tear.

6.3 Damage Assessment
We will provide an itemized estimate of any damage charges within 5 business days of pickup.

7. Supervision & Safety

You are responsible for ensuring that all participants, including children, use equipment safely. Equipment must not be climbed on, jumped on, or misused.

8. Weather & Environment

You are responsible for protecting equipment from severe weather or unsafe conditions during the rental period.

We reserve the right to delay, reschedule, or cancel delivery if conditions pose a safety risk. In such cases, you may choose rescheduling or a full refund.

9. Delivery, Setup & Access

We will deliver and set up equipment at the agreed location. You are responsible for ensuring the site is accessible and ready at the scheduled time.

We are not responsible for delays caused by venue conditions.

10. Travel Fees

Events located outside of Chico, California may be subject to a travel fee. Travel fees are calculated at a rate of $2.00 per mile based on the distance between Chico, CA and the event location.

A Backyard Birdies Chico representative will review your event details and notify you of any applicable travel fees prior to finalizing your booking.

11. Overtime

If equipment is retained beyond the agreed rental period, additional charges may apply, typically equivalent to a half-day rental rate.

12. Assumption of Risk & Liability Waiver

Participation in mini golf and related activities involves inherent risks.

By using our services, you:

-Assume full responsibility for supervising all participants

-Accept all risks associated with use of the equipment

To the fullest extent permitted by law, you agree to release and hold harmless Backyard Birdies Chico and its owners, employees, and representatives from any claims, injuries, damages, or losses arising from use of the equipment, except in cases of gross negligence or willful misconduct.

13. Indemnification

You agree to indemnify, defend, and hold harmless Backyard Birdies Chico from any claims, damages, losses, liabilities, and expenses arising out of:

-Your use of the services

-Your event

-Any breach of these Terms

14. SMS Messaging Terms & A2P Compliance

14.1 Program Description

-Booking confirmations
